At Markettrend, we are committed to delivering high-quality mobile application development services that meet your expectations. This Return Policy outlines the terms and conditions under which refunds and cancellations may be requested for our services. Please read this policy carefully before engaging our services.
Nature of Services
Our services involve custom software development, design work, and consulting services that are tailored specifically to each client's requirements. Due to the customized and time-intensive nature of our work, our return and refund policies differ from those applicable to physical products or off-the-shelf software.
Project Cancellation Policy
Clients may request to cancel a project at any time by providing written notice to Markettrend. However, cancellation does not automatically entitle you to a full refund. The refund amount, if any, will be determined based on the stage of the project and the work completed up to the point of cancellation.
Cancellation During Discovery Phase
If you cancel a project during the initial discovery and planning phase, before any design or development work has commenced, you may be eligible for a refund of up to 80% of the total project fee. A cancellation fee of 20% will be retained to cover administrative costs, initial consultations, and project setup activities.
Cancellation During Design Phase
If you cancel a project after design work has begun but before development commences, you will be charged for all completed design work, including wireframes, mockups, and prototypes. Any remaining balance after deducting the cost of completed work and a 15% administrative fee may be refunded.
Cancellation During Development Phase
If you cancel a project after development has commenced, you will be charged for all work completed up to the cancellation date, including design, development, testing, and project management hours. This will be calculated based on the percentage of project completion and the resources allocated to your project. No refund will be issued if more than 60% of the project has been completed.
Refund Eligibility
Refunds may be considered under the following circumstances:
Service Not Delivered: If we fail to deliver the agreed-upon services as specified in the service agreement and are unable to remedy the situation within a reasonable timeframe, you may be eligible for a partial or full refund.
Material Breach: If Markettrend materially breaches the terms of the service agreement and fails to cure such breach within 30 days of written notice, you may be entitled to a refund of fees paid for undelivered services.
Mutual Agreement: In certain circumstances, both parties may mutually agree to terminate the project and negotiate a fair refund amount based on work completed and expenses incurred.
Non-Refundable Items
The following items and services are non-refundable under any circumstances:
Initial consultation fees and discovery session charges are non-refundable once the sessions have been conducted, as these involve dedicated time and expertise from our team.
Third-party costs incurred on your behalf, including but not limited to app store fees, hosting charges, domain registrations, third-party API subscriptions, and licensed software or assets purchased specifically for your project.
Completed and delivered work that meets the specifications outlined in the service agreement, even if you choose not to use or implement the deliverables.
Rush fees or expedited service charges paid for accelerated project timelines.
Refund Request Process
To request a refund or cancel a project, you must submit a written request via email to our customer service team. Your request should include your project details, the reason for the refund request, and any supporting documentation.
We will review your request within 10 business days and respond with our decision. If your refund request is approved, we will process the refund within 30 days of approval. Refunds will be issued using the same payment method used for the original transaction, unless otherwise agreed upon.
Dispute Resolution
If you are dissatisfied with our services or have concerns about deliverables, we encourage you to contact us immediately so we can address the issue. We are committed to working with our clients to resolve any concerns and ensure satisfaction with our services.
Before requesting a refund, we ask that you give us the opportunity to remedy any issues or concerns you may have. In many cases, we can address problems through revisions, additional support, or other accommodations.
Quality Assurance
All deliverables undergo thorough quality assurance testing before being presented to clients. We stand behind the quality of our work and will address any bugs, errors, or issues that arise during the agreed-upon warranty period at no additional cost.
However, requests for changes to project scope, additional features, or modifications to approved designs may incur additional charges and are not covered under this Return Policy.
Payment Plans and Refunds
For projects with milestone-based payment plans, refunds will be calculated based on completed milestones. If you have paid for a milestone that has not yet been completed, that portion may be eligible for refund, subject to the terms outlined in this policy.
Any refund issued will take into account all payments received, work completed, and expenses incurred up to the date of cancellation.
Intellectual Property Considerations
In the event of a project cancellation and refund, intellectual property rights to any work completed will be determined based on the amount paid and refunded. Generally, if a full refund is issued, all intellectual property rights remain with Markettrend. If partial payment is retained for work completed, intellectual property rights to that completed work may be transferred to you as outlined in the service agreement.
Modification of Services
If you wish to modify the scope of services after a project has commenced, we will work with you to adjust the project plan and pricing accordingly. Scope changes may affect project timelines and costs. Any additional work beyond the original scope will be subject to additional fees.
Force Majeure
Markettrend shall not be liable for any delay or failure to perform our obligations under a service agreement due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, labor disputes, or technical failures. In such cases, we will work with you to reschedule or adjust the project timeline, but no refunds will be issued for delays caused by force majeure events.
Client Responsibilities
Timely refunds and project completion depend on your cooperation and timely provision of necessary materials, information, and approvals. Delays caused by your failure to provide required inputs may affect project timelines and your eligibility for refunds.
You are responsible for reviewing and approving deliverables within the timeframes specified in the service agreement. Failure to provide timely feedback may result in project delays and additional charges.
Warranty Period
We provide a warranty period for all completed projects, during which we will address any bugs or technical issues at no additional cost. The standard warranty period is 90 days from the date of final delivery, unless otherwise specified in your service agreement.
The warranty covers technical defects and functionality issues but does not include new features, design changes, or modifications to the original scope of work.
Changes to This Policy
We reserve the right to modify this Return Policy at any time. Any changes will be posted on our website with an updated "Last Updated" date. Changes to this policy will not affect projects already in progress unless mutually agreed upon by both parties.
